§ 1 Scope
(1) These general terms and conditions (“Terms”) apply to the use of the online platform HalalReservation (halalreservation.com) and to all bookings made via the platform between [FIRMENNAME] [RECHTSFORM], [ANSCHRIFT – STRASSE UND HAUSNUMMER], [PLZ] [ORT], Deutschland (“HalalReservation”, “we”) and the users of the platform (“you”).
(2) Deviating or supplementary terms of users do not form part of the contract unless we expressly agree to their validity.
(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A business is any natural or legal person or partnership with legal capacity acting in the exercise of its trade, business or profession (§ 14 BGB).
(4) Separate partner terms additionally apply to hotels and hotel partners offering accommodation via HalalReservation (§ 11).
§ 2 Services of HalalReservation; role as intermediary
(1) HalalReservation operates an online platform on which you can find information about halal-friendly hotels, compare prices and availability, and book hotel rooms.
(2) HalalReservation acts as an intermediary and does not itself provide accommodation services. The accommodation contract is concluded directly between you and the respective hotel. For hotels we offer via our partner TBO Holidays (TBO Tek Limited), the accommodation contract is concluded with the partner or the hotel in accordance with that partner’s terms. [VERTRAGSMODELL ANWALTLICH ZU PRÜFEN] The conditions applicable to the selected rate are shown to you before you complete the booking.
(3) You conclude an intermediary contract with HalalReservation. Our services comprise presenting the offers, arranging and forwarding your booking including special requests to the hotel or partner, processing the payment, providing your customer account and customer service relating to your booking.
(4) Ranking of search results: In the default sorting (“Recommended”), hotels with available prices are shown first; within these groups, hotels highlighted by us are shown before the others, followed by sorting by star rating. You can change the sorting to price, rating or star rating and filter the results (e.g. by halal level) at any time. § 3 Customer account
(1) Certain functions – such as managing and cancelling bookings, favourites, reviews and messages – require a customer account. Registration and use of the customer account are free of charge.
(2) If you book without an existing customer account, a customer account is created automatically using the details provided during booking. You will receive an email with a link to activate your account and set a password.
(3) You are obliged to provide truthful and complete information, to keep your login details secret and to inform us immediately if there are indications that your account is being misused.
(4) You can have your customer account deleted at any time, e.g. by email to [E-MAIL]. In the event of serious or repeated breaches of these Terms, we may temporarily or permanently suspend your account, taking your legitimate interests into account. Bookings that have already been confirmed remain unaffected.
§ 4 Booking process and conclusion of contract
(1) The presentation of hotels, rooms, rates and prices on the platform does not constitute a binding offer but an invitation to you to make a booking.
(2) The booking process is as follows:
- You select the hotel, room, rate, travel dates and number of guests and click “Reserve Now”.
- On the checkout page you enter your guest details and, optionally, special requests.
- You check the booking summary with the total price, price components and cancellation conditions. You can correct input errors at any time before submitting, using the input fields or your browser’s back function.
- You confirm that you accept these Terms and enter your payment details in Stripe’s payment form.
- By clicking the button “Pay … & Confirm” you submit a binding offer to conclude the booking contract.
(3) The contract is concluded when we confirm your booking by email (booking confirmation). If a booking cannot be confirmed – for example because the room is no longer available – we will inform you without delay and refund any payments already made in full.
(4) The contract languages are German, English and Turkish; the German version is authoritative. We store the contract text. You receive your booking details with the booking confirmation and can access them at any time in your customer account under “My bookings”. You can access, print or save these Terms on this page at any time.
§ 5 Prices and payment
(1) The prices displayed at the time of booking apply. The total price consists of the room price for the selected period, taxes and charges (12% of the room price) and a HalalReservation service fee (5% of the room price). All components are shown on the checkout page before you complete the booking.
(2) Prices are stated in euros unless another currency is expressly displayed. If you pay with a means of payment in another currency, your bank or card issuer may charge conversion fees.
(3) Fees charged directly at the hotel – e.g. city tax, tourist tax, resort fees or deposits – are not included in the total price unless expressly stated otherwise and are payable to the hotel on site. Where we are aware of such fees, we point them out before booking.
(4) Payment is made at the time of booking via our payment service provider Stripe using the payment methods offered there (e.g. credit or debit card). The total amount is due upon completion of the booking. Stripe’s terms additionally apply to the payment process.
§ 6 Halal features and hotel information
(1) Information on halal features (e.g. halal level, halal catering, alcohol-free areas, prayer facilities, separate wellness and pool areas) and other hotel information (descriptions, amenities, images) is based on information provided by the hotels or our partners.
(2) We check this information for plausibility with reasonable care and follow up on indications of inaccuracies. We do not guarantee that the information is correct, complete and up to date unless otherwise provided in § 10. HalalReservation’s halal levels are our own classification based on this information and not a religious or official certification, unless such a certification is expressly stated.
(3) We forward special requests (e.g. removal of alcoholic drinks from the minibar, prayer mat, marking of the qibla) to the hotel or partner. Their fulfilment cannot be guaranteed unless they are expressly shown as part of the booked rate.
(4) If the accommodation on site differs from the information provided, please first contact the hotel and inform us promptly so that we can mediate.
§ 7 Cancellation, changes and no-show
(1) Whether and under which conditions you can cancel a booking depends on the cancellation conditions of the booked rate. These are shown before you complete the booking and can be accessed in your booking confirmation and your customer account. For details see Withdrawal & Cancellation.
(2) There is no statutory right of withdrawal for accommodation services booked for a specific date or period (§ 312g(2) no. 9 BGB). A booking is therefore binding unless the rate provides for free cancellation.
(3) If you do not arrive without having cancelled in time (no-show), the full price or the fee stated in the cancellation conditions may be charged. Your right to prove that no damage or less damage has been incurred or that expenses have been saved remains unaffected.
(4) Changes to a booking (e.g. travel dates, room type, number of guests) are only possible with the consent of the hotel or partner; as a rule, this requires a cancellation under the applicable conditions and a new booking.
§ 8 Obligations of guests
(1) You are obliged to provide correct information when booking, in particular regarding names, contact details and the number of guests, and to make bookings only for yourself or for persons who have authorised you to do so.
(2) You are responsible for complying with the entry, passport, visa and health regulations of the destination country and for meeting the hotel’s check-in requirements (e.g. ID, minimum age, credit card for deposits). The hotel’s house rules must be observed.
(3) The messaging function may only be used for matters relating to bookings and stays. In particular, advertising, harassment and unlawful content are prohibited.
§ 9 Reviews
(1) Registered users can review hotels. Reviews linked to a booking made via HalalReservation are marked as “verified”. Only for these reviews is it ensured that they come from a guest who booked the hotel through us. Reviews without a link to a booking are not marked as verified.
(2) Reviews must be based on your own experience and be objective and truthful. In particular, offensive, discriminatory, unlawful or promotional content, reviews in return for consideration, reviews of your own or competing properties and the publication of third parties’ personal data are prohibited.
(3) We publish permissible reviews regardless of whether they are positive or negative. We may reject or remove reviews that violate these rules; we will inform you of such a decision and state the reasons.
(4) You grant us the simple, free-of-charge right, unlimited in time and territory, to publish your review on the platform and to adapt it technically for display or translate it.
(5) You can report unlawful content on the platform to us at any time by email to [E-MAIL]. Please state the exact location and explain why the content is unlawful.
§ 10 Liability
(1) We are liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or by gross negligence, where we have given a guarantee, where a defect has been fraudulently concealed and under the German Product Liability Act.
(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the damage that was foreseeable and typical for the contract at the time the contract was concluded. Essential contractual obligations (cardinal obligations) are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely.
(3) Otherwise, our liability for damage caused by slight negligence is excluded.
(4) The above limitations of liability also apply in favour of our legal representatives, employees and vicarious agents.
(5) The respective hotel or contractual partner is responsible for providing the accommodation service itself in accordance with the provisions applicable to the accommodation contract. Our liability for proper intermediation remains unaffected.
(6) We strive to keep the platform available without interruption. However, maintenance work, security measures or disruptions beyond our control may lead to temporary restrictions.
§ 11 Hotel partners
Separate partner terms additionally apply to hotels, hoteliers and other providers who offer their accommodation via HalalReservation, register a hotel or use the hotelier account [PARTNERBEDINGUNGEN – SEPARAT ZU ERSTELLEN]. Hotel partners are in particular obliged to provide truthful and up-to-date information on halal features, amenities, prices and availability and to honour confirmed bookings.
§ 12 Consumer dispute resolution
[AUSWAHL ERFORDERLICH: TEILNAHME AN VERBRAUCHERSCHLICHTUNG JA ODER NEIN] We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
§ 13 Governing law and place of jurisdiction
(1) Contracts with HalalReservation are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive you of the protection afforded by the mandatory provisions of the law of the country in which you have your habitual residence.
(2) The accommodation contract with the hotel or partner is governed by the law agreed in that contract or by the applicable statutory law.
(3) If you are a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contract with HalalReservation is our registered office ([ORT]). Statutory exclusive places of jurisdiction remain unaffected.
§ 14 Amendments and final provisions
(1) Bookings are subject to the version of the Terms valid at the time of booking. We will notify you in text form in good time of any changes to these Terms for the further use of the customer account.
(2) Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provisions (§ 306(2) BGB).
Note: These legal texts are drafts and must be reviewed by a lawyer before go-live.
